GoJourney Release of Liability
Definitions
- “GoJourney”, “Go Journey”, “Platform”, “We”: Refer to the online travel platform provided by GoJourney LLC, including its website, mobile app, and services.
- “Customer”, “User”: Refer to GoJourney customers.
- “Service Provider”, “Guide”: Refer to service providers that organize and lead the trips booked at the platform.
- “Journey”, “Trip”, “Adventure”, “Activity”, “You”: Refer to the trip arrangements which customers book with the guides through GoJourney and which we agree to provide or perform (as applicable) as part of our contract with you.
Acknowledgment of Risks and Acceptance of Responsibility
As you embark on your chosen adventure facilitated through GoJourney, you’re stepping closer to nature and thrilling experiences. While GoJourney is a platform that connects adventurers with independent guides, it’s essential to acknowledge the inherent risks involved in outdoor activities. We mandate that all adventurers and guides understand these risks and consent to our Waiver/Release of Liability as a fundamental prerequisite for using our service.
Understanding the Risks
Activities like rock climbing, hiking, surfing, and paragliding, among other outdoor adventures, inherently carry risks. These risks may include, but are not limited to, bodily injury, property damage, or death resulting from the inherent dangers of the activity, the negligence of others, or unforeseen circumstances.
Your Responsibility
By choosing to participate in any activity booked through GoJourney, you acknowledge and agree to the following:
- You fully understand the nature and extent of the risks involved.
- You willingly accept all risks related to the activity, encompassing those arising from other participants and guides’ conduct or lack thereof.
- You accept full responsibility for any personal injury, property damage, or other loss that you may sustain.
GoJourney Responsibility Limitations
GoJourney acts as an intermediary between users and service providers. We are not liable for the actions, negligence, or failures of the service providers. GoJourney cannot accept responsibility for any services which do not form part of our contract.
Waiver and Release of Liability
By agreeing to this waiver:
- To the fullest extent permitted by law, you voluntarily release GoJourney, its employees, agents, and associated guides from all claims, demands, or causes of action arising from your participation in any activity arranged through our platform.
- You understand and accept that this release is legally binding and will be enforceable against you, your heirs, successors, assignees, and legal representatives.
- You recognize that this waiver constitutes a comprehensive release of liability that applies to all injuries and damages, and you willingly relinquish any right to take legal action against GoJourney for its negligence.
Confirmation of Agreement
By signing this form or clicking the “I Agree to the Waiver Terms***” you affirm that you have read this Waiver/Release of Liability, comprehend its contents, and consent to its terms.
Your selection of the “I Agree to the Waiver Terms” confirms your understanding of the inherent risks associated with the activities and your voluntary acceptance of those risks. If you do not agree to these terms, you will not be permitted to engage in any activities provided by GoJourney.
