GoJourney Waiver/Release of Liability

READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS AND INCLUDES A RELEASE OF LIABILITY, WAIVER OF CLAIMS, COVENANT NOT TO SUE, AND INDEMNITY. Last updated: January 25, 2026 This Waiver, Release of Liability, and Indemnity Agreement (“Agreement”) is entered into by the undersigned participant (“I,” “me,” “my”) in favor of GoJourney LLC and its owners, officers, directors, employees, contractors, agents, affiliates, successors, and assigns (collectively, “GoJourney”).

1. Marketplace Role; No Service Provider; No Duty to Verify

I understand and agree that GoJourney is a technology platform and marketplace that facilitates connections between Customers and independent third-party Guides and service providers (“Guides”). GoJourney does not provide, operate, supervise, control, direct, manage, or deliver any Journey, does not act as a tour operator, outfitter, or guide, and is not a party to any agreement between me and any Guide. I understand that GoJourney does not guarantee, verify, or warrant any Guide’s identity, qualifications, training, experience, permits, certifications, equipment, safety practices, insurance coverage, pricing, or suitability, and GoJourney has no duty to conduct background checks or verify any Guide information.

2. Definitions

“Journey” means any outdoor, adventure, sport, travel, lesson, tour, activity, trip, experience, event, or service offered by a Guide that I discover, book, attend, participate in, or otherwise engage in through or in connection with the GoJourney platform, including any related travel, transportation, lodging, equipment use, or ancillary activities.

3. Inherent and Additional Risks; ASSUMPTION OF ALL RISK

I understand that Journeys and related activities involve inherent and additional risks that may result in serious bodily injury, permanent disability, illness (including contagious disease), property damage, economic loss, or death. These risks include, without limitation:

• Slips, trips, falls; collisions; falling objects; rockfall; avalanche; crevasse/ice hazards; water hazards including drowning; surf/river/ocean currents; altitude illness; hypothermia/hyperthermia; lightning; wildfire smoke; severe weather; remote locations and delayed rescue;
• Equipment failure, improper fit, misuse, or malfunction of gear; rental gear issues; vehicle/transportation incidents; trail/terrain hazards; changing conditions; wildlife;
• Actions, omissions, negligence, recklessness, or misconduct of Guides, other participants, landowners, third parties, bystanders, or other service providers;
• Communication failures, misunderstandings, limited information, errors in listings, maps, routes, or instructions;
• Risks arising from my own physical or mental condition, fatigue, hydration, medical conditions, medication, or failure to follow instructions.

I voluntarily choose to participate and ASSUME ALL RISKS, whether known or unknown, foreseeable or unforeseeable, including risks arising from the ordinary negligence of any Released Party (as defined below) and/or any Guide or third party, to the maximum extent permitted by law.

4. Participant Representations and Responsibilities

I represent, warrant, and agree that: (a) I am physically and mentally capable of participating and will not participate while impaired by alcohol, drugs, or any condition that makes participation unsafe; (b) I will follow all safety rules and instructions, use appropriate protective equipment, and ask questions when uncertain; (c) I will truthfully disclose relevant medical conditions to the Guide if appropriate and understand that the Guide and GoJourney are not responsible for assessing my fitness; (d) I will stop participation if I feel unsafe or unwell; (e) I will comply with all applicable laws, rules, regulations, and land-use requirements.

5. RELEASE OF LIABILITY; WAIVER OF CLAIMS

TO THE MAXIMUM EXTENT PERMITTED BY LAW, I, on behalf of myself and my heirs, assigns, and personal representatives, hereby IRREVOCABLY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS GoJourney and each of its owners, officers, directors, employees, contractors, agents, affiliates, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, damages, losses, liabilities, costs, or expenses of any kind, whether known or unknown, suspected or unsuspected, arising out of or relating to:

• my use of the GoJourney platform;
• my participation in any Journey;
• any acts or omissions of any Guide, participant, or third party;
• any representation, listing, communication, or information provided by a Guide or any third party;
• any injury, illness, death, property damage, economic loss, refund dispute, cancellation, dissatisfaction, or service quality issue,

INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY, to the maximum extent permitted by law.

6. COVENANT NOT TO SUE; BREACH CONSEQUENCES

I agree that I will NOT SUE or initiate or maintain any lawsuit, claim, demand, arbitration, or other proceeding against any Released Party for any matter released under this Agreement. If I breach this covenant, I agree that I will be responsible for and will reimburse the Released Parties for all costs and expenses, including reasonable attorneys’ fees, incurred in defending against such claim, to the maximum extent permitted by law.

7. INDEMNIFICATION; DEFENSE

I agree to DEFEND, INDEMNIFY, AND HOLD HARMLESS the Released Parties from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) my participation in any Journey; (b) my breach of this Agreement; (c) my violation of any law, rule, or regulation; (d) my acts or omissions, including injury or damage caused by me to any person or property; or (e) claims brought by any third party arising from my conduct or participation. GoJourney may, at its option, assume the defense of any matter subject to indemnification, and I agree to cooperate fully.

8. MEDICAL AUTHORIZATION; RESCUE; COSTS

In the event of an emergency, I authorize Guides, GoJourney, and/or emergency personnel to provide, obtain, or arrange medical care, evacuation, rescue, and transportation as deemed necessary. I understand and agree that I am solely responsible for all costs related to medical treatment, rescue, evacuation, and transportation, whether arranged by a Guide, GoJourney, or any third party.

9. INSURANCE ACKNOWLEDGMENT

I understand that Guides and Customers are responsible for their own insurance decisions. I acknowledge that GoJourney does not provide medical, accident, liability, or travel insurance for me. I accept full responsibility for obtaining any insurance I consider appropriate.

10. NO RELEASE WHERE PROHIBITED

Nothing in this Agreement is intended to release, waive, or limit claims that cannot be released under applicable law, including, where applicable, claims based on gross negligence or intentional misconduct.

11. WAIVER OF UNKNOWN CLAIMS

I acknowledge that I may discover facts or suffer damages in the future that are different from or in addition to those I now know or believe to be true. Nonetheless, I intend this Agreement to be a full and final release of all claims described above, whether known or unknown, suspected or unsuspected, to the maximum extent permitted by law.

12. TIME LIMIT TO BRING CLAIMS

To the maximum extent permitted by law, I agree that any claim against any Released Party that is not prohibited by Section 10 must be brought within one (1) year from the date of the event giving rise to the claim, or it is forever barred.

13. GOVERNING LAW; EXCLUSIVE VENUE; JURY TRIAL WAIVER

This Agreement shall be governed by the laws of the State of Washington, without regard to conflict-of-law principles. To the maximum extent permitted by law, any dispute arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in King County, Washington, and I consent to personal jurisdiction there. TO THE MAXIMUM EXTENT PERMITTED BY LAW, I WAIVE ANY RIGHT TO A TRIAL BY JURY in any action or proceeding involving any Released Party arising out of or relating to this Agreement.

14. SEVERABILITY; ENTIRE AGREEMENT; SURVIVAL

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between me and GoJourney regarding the subject matter of this Agreement and supersedes any prior or contemporaneous communications. The release, covenant not to sue, indemnification, venue, and related provisions shall survive completion of the Journey and termination of platform use.

15. AGE REPRESENTATION

I represent and warrant that I am at least eighteen (18) years old and not a Minor.

16. ACKNOWLEDGMENT AND SIGNATURE

I acknowledge that I have carefully read this Agreement, fully understand its contents, understand that I am giving up substantial legal rights, and sign it freely and voluntarily.
