GoJourney Terms and Conditions
1. Definitions
1.1. “GoJourney”, “Go Journey”, “Platform”, “We”: Refer to the online travel platform provided by GoJourney LLC, including its website, mobile app, and services.
1.2. “Customer”, “User”: Refer to GoJourney customers.
1.3. “Service Provider”, “Guide”: Refer to service providers that organize and lead the trips booked at the platform.
1.4. “Journey”, “Trip”, “Adventure”, “Activity”: Refer to the trip arrangements which customers book with the guides through GoJourney and which we agree to provide or perform (as applicable) as part of our contract with you.
2. Acceptance of Terms and Conditions
2.1. By accessing and using GoJourney, you agree to comply with and be bound by the following terms and conditions. If you do not agree with any part of these terms, please do not use our services.
3. Booking and Payments
3.1. All bookings are subject to availability.
3.2. Booking arrangements are facilitated directly between the Guide and the User. GoJourney acts as an intermediary and is not a party to the booking contract.
3.3. Full payment is required at the time of booking unless otherwise specified.
3.4. Prices are subject to change without notice.
4. Cancellation and Refund Policy
4.1. Cancellation fees may apply. Refer to specific bookings for details.
4.2. Refund policies vary by service.
4.3. Refunds, if applicable, will be processed according to our refund policy.
5. Journey Itinerary
5.1. The itinerary is a guide to which the guide will attempt to adhere, but it may be necessary to alter this at short notice as a result of circumstances or events outside our control such as adverse weather or road conditions or any of those amounting to force majeure, or due to the operating conditions imposed by owners and operators of accommodation, facilities and transport. Your itinerary will, however, be the same in content as far as is reasonably possible, unless circumstances beyond our control make this impossible, or the change is mutually agreed between the customer and the guide.
6. Travel Insurance
6.1. GoJourney is not responsible for any loss, injury, or damage during travel.
6.2. GoJourney strongly recommends that customers purchase comprehensive travel insurance to cover unforeseen events, including but not limited to: interruption, cancellation, medical emergency transportation, evacuation and repatriation, illness, accidental death and disability, travel accident/sickness medical expenses, and more. Proper insurance may protect you from financial loss in almost all circumstances.
6.3. By declining appropriate travel insurance, cutomers acknowledges and accepts liability for any cancellation penalties, damages and/or out–of-pocket expenses incurred.
6.4. Customers acknowledge and agree that GoJourney has no control over the travel insurance provider or its coverage decisions, and as a result GoJourney is not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims.
7. Itinerary Changes
7.1. We reserve the right to modify journey itineraries due to unforeseen circumstances.
7.2. Any changes will be communicated promptly to affected customers.
8. Customer responsibilities
8.1. Customers are responsible for providing accurate information during the booking process.
8.2. Adherence to destination- and activity-specific rules and regulations is the customer’s responsibility.
8.3. Travelers must adhere to a respectful and considerate code of conduct.
8.4. Disruptive behavior may result in expulsion from trips or activities.
8.5. You may not transfer your trip booking to someone else.
9. Health
9.1. You are taken to confirm at the time of booking that you are in good health, physically capable of undertaking all aspects of the journey, and unaware of any reason why you may be unsuited to taking part or may be likely to suffer illness or injury during the trip, taking into account its challenges and purposes. If you are unable to give for this confirmation for any reason or have any medical condition or disability which may affect your trip, you must contact us before booking the trip so that we can assist you in considering the suitability of the trip for you.
9.2. If any information given in the application form or medical questionnaire is shown to be materially incorrect or incomplete, we reserve the right to cancel your booking or terminate your participation in the trip, depending on when we become aware of the true position. In this situation, we will not be responsible for any costs or expenses incurred as a result.
10. Assumption of Risk and Release of Liability
10.1. All customers must sign a GoJourney Release of Liability form prior to starting the activity.
11. Force Majeure
11.1. GoJourney is not liable for failure to perform our obligations due to unforeseen circumstances beyond our control.
12. Intellectual Property
12.1. Content Ownership: Every element on GoJourney, encompassing written material, visual designs, emblems, and software, belongs to GoJourney or its content providers and is safeguarded under global copyright regulations.
12.2. User-Generated Content: You maintain complete ownership and bear exclusive responsibility for any User Content you upload to GoJourney.
13. Termination of Access
13.1. GoJourney reserves the right to terminate or suspend your access to the Platform, with or without notice, for any reason, including but not limited to a violation of these Terms and Conditions.
14. Governing Law and Dispute Resolution
14.1. These terms are governed by the laws of Washington State, without regard to its conflict of laws principles.
14.2. Users agree to submit to the exclusive jurisdiction of the courts in King County Washington State.
15. Updates to Terms
15.1. GoJourney reserves the right to update these terms and conditions; check our website for the latest version.
