GoJourney Terms & Conditions Last updated: January 25, 2026
1. Definitions
1.1. “GoJourney”, “Go Journey”, “Platform”, “We”: Refer to the online marketplace platform provided by GoJourney LLC, including its website, tools, and services that facilitate connections between Customers and Guides.
1.2. “Customer”, “User”: Refer to individuals who access the Platform to discover, communicate with, and book Journeys with Guides.
1.3. “Service Provider”, “Guide”: Refer to independent third-party service providers that list, organize, and lead Journeys offered through the Platform.
1.4. “Journey”, “Trip”, “Adventure”, “Activity”: The experience, activity, trip, or service offered, organized, and delivered by a Guide and booked by a Customer through or in connection with the Platform. GoJourney does not provide, operate, supervise, or control Journeys and does not act as a tour operator, outfitter, or guide.
1.5. “Minor”: Any individual under the age of eighteen (18) years.
1.6. “Payment Processor”: Stripe and any other third-party payment processor used to facilitate payments on or through the Platform.
1.7. “Connected Account”: A Guide’s Stripe account connected to the Platform via Stripe Connect.
1.8. “Platform Fees”: Any fees charged by GoJourney for use of the Platform or Platform Services (excluding amounts paid to Guides for Journeys).
2. Acceptance of Terms and Conditions
2.1. By accessing and using GoJourney, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these Terms, please do not use the Platform.
3. Age Restrictions
3.1. GoJourney does not permit the participation of minors. All Users, Customers, and Guides must be at least eighteen (18) years of age.
3.2. By using the Platform, booking a Journey, or offering services as a Guide, you represent and warrant that you are at least eighteen (18) years old.
3.3. GoJourney reserves the right to request proof of age and to suspend or terminate access to the Platform if a User or Guide is found to be under eighteen (18).
4. Booking and Payments
4.1. All bookings are subject to availability.
4.2. Booking arrangements are facilitated directly between the Guide and the User. GoJourney acts as an intermediary and is not a party to the booking contract. GoJourney does not supervise, control, or direct Guides and is not responsible for verifying their qualifications, permits, certifications, or insurance coverage. Any payment processing through the Platform does not make GoJourney a seller, provider, or merchant of record for any Journey unless expressly stated otherwise on the Platform.
4.3. Payment Processing (Stripe). The Platform may enable Customers to pay for Journeys using a third-party Payment Processor (currently, Stripe). GoJourney is not a bank or money transmitter. Payment processing services are provided by the Payment Processor and are subject to the Payment Processor’s terms and policies.
4.4. Guide Stripe Connection. Guides that accept payments through the Platform must connect a Stripe account (“Connected Account”) and comply with all requirements imposed by Stripe and applicable law.
4.5. Full Payment. Full payment is required at the time of booking unless otherwise specified on the Platform or by the Guide’s stated booking terms.
4.6. Pricing. Prices are set by Guides (and any applicable Platform Fees are set by GoJourney) and are subject to change without notice.
4.7. Platform Fees. GoJourney may charge Platform Fees and/or service fees. Unless expressly stated otherwise, Platform Fees are non-refundable except where required by law.
4.8. Refunds and Cancellations. Guides are solely responsible for setting and honoring their cancellation and refund policies (to the extent permitted by law) and for responding to refund requests. GoJourney may, but is not obligated to, assist with communications or facilitate refunds through the Payment Processor.
4.9. Chargebacks and Disputes. If a Customer initiates a chargeback, dispute, or payment reversal, GoJourney may (but is not required to) respond to the dispute and provide relevant information to the Payment Processor. Guides remain solely responsible for the underlying services and any obligations to Customers.
4.10. Recovery; Setoff; Negative Balances. GoJourney may recover from a Guide any amounts (including fees, penalties, or costs) incurred by GoJourney or debited by the Payment Processor in connection with disputes, chargebacks, refunds, reversals, or negative balances attributable to that Guide’s Journeys, including by deducting such amounts from future payouts or other amounts owed to the Guide. If a Connected Account has insufficient balance to cover such amounts, the Guide remains responsible for any remaining deficiency.
5. Cancellation and Refund Policy
5.1. Cancellation fees may apply. Refer to the specific booking and the Guide’s stated policy for details.
5.2. Refund policies vary by Guide and by Journey.
5.3. Refunds, if applicable, will be processed according to the applicable refund policy and, where relevant, the Payment Processor’s procedures.
6. Journey Itinerary
6.1. The itinerary is a guide to which the Guide will attempt to adhere, but it may be necessary to alter this at short notice as a result of circumstances or events outside our control such as adverse weather or road conditions or any of those amounting to force majeure, or due to operating conditions imposed by owners and operators of accommodation, facilities and transport. Your itinerary will, however, be the same in content as far as is reasonably possible, unless circumstances beyond our control make this impossible, or the change is mutually agreed between the Customer and the Guide.
7. Travel Insurance
7.1. GoJourney is not responsible for any loss, injury, or damage during travel.
7.2. GoJourney strongly recommends that Customers purchase comprehensive travel insurance to cover unforeseen events, including but not limited to: interruption, cancellation, medical emergency transportation, evacuation and repatriation, illness, accidental death and disability, travel accident/sickness medical expenses, and more. Proper insurance may protect you from financial loss in almost all circumstances.
7.3. By declining appropriate travel insurance, Customers acknowledge and accept liability for any cancellation penalties, damages and/or out-of-pocket expenses incurred.
7.4. Customers acknowledge and agree that GoJourney has no control over the travel insurance provider or its coverage decisions, and as a result GoJourney is not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims.
7.5. The travel insurance referenced in this section applies to Customers only. Guides are responsible for maintaining their own insurance coverage as described in Section 10.
8. Itinerary Changes
8.1. We reserve the right to modify Journey itineraries due to unforeseen circumstances.
8.2. Any changes will be communicated promptly to affected Customers where reasonably possible.
9. Customer Responsibilities
9.1. Customers are responsible for providing accurate information during the booking process.
9.2. Adherence to destination- and activity-specific rules and regulations is the Customer’s responsibility.
9.3. Travelers must adhere to a respectful and considerate code of conduct.
9.4. Disruptive, unsafe, or unlawful behavior may result in removal from a Journey and/or suspension or termination of Platform access.
9.5. You may not transfer your Journey booking to someone else without the Guide’s express approval.
10. Guide Responsibilities and Requirements
10.1. Eligibility. All Guides must be at least eighteen (18) years old and legally permitted to provide the services offered.
10.2. Experience and Qualifications. Guides represent and warrant that they possess the appropriate experience, training, skills, and qualifications necessary to safely and professionally conduct the Journeys they offer.
10.3. Permits and Certifications. Guides are solely responsible for obtaining, maintaining, and complying with all licenses, permits, certifications, and authorizations required under applicable local, state, federal, or international laws for the activities they offer. This may include, but is not limited to, professional guiding certifications, land-use permits, and commercial operating permits.
10.4. Insurance. Guides must maintain, at their own expense, all insurance coverage required by law and reasonably appropriate for the activities offered, including but not limited to:
(a) Commercial general liability insurance;
(b) Professional liability insurance where applicable; and
(c) Any additional insurance required by applicable authorities, land managers, or governing bodies.
10.5. Compliance. Guides agree to comply with all applicable laws, regulations, safety standards, and industry best practices.
10.6. Independent Responsibility. GoJourney does not verify, endorse, or guarantee any Guide’s qualifications, permits, certifications, or insurance coverage. Guides are solely responsible for their services and compliance.
11. Health
11.1. You confirm at the time of booking that you are in good health, physically capable of undertaking all aspects of the Journey, and unaware of any reason why you may be unsuited to taking part or may be likely to suffer illness or injury during the Journey, taking into account its challenges and purposes. If you have any medical condition or disability which may affect your Journey, you must contact the Guide before booking so that you can consider the suitability of the Journey.
11.2. If any information given is shown to be materially incorrect or incomplete, we reserve the right to cancel your booking or terminate your participation in the Journey, depending on when we become aware of the true position. In this situation, we will not be responsible for any costs or expenses incurred as a result.
12. Assumption of Risk; Waiver/Release
12.1. Outdoor and adventure activities involve inherent risks, including the risk of serious injury, permanent disability, or death.
12.2. All Customers may be required to sign a GoJourney Waiver/Release of Liability prior to participating in a Journey, and Guides may require additional waivers or acknowledgments as part of their services.
13. Force Majeure
13.1. GoJourney is not liable for failure to perform obligations due to unforeseen circumstances beyond our reasonable control.
14. Intellectual Property; User Content
14.1. Content Ownership. Every element on GoJourney, including written material, visual designs, emblems, and software, belongs to GoJourney or its licensors and is protected under applicable intellectual property laws.
14.2. User-Generated Content. You retain ownership of any content you upload or submit to the Platform (“User Content”).
14.3. License to GoJourney. By submitting User Content, you grant GoJourney a worldwide, non-exclusive, royalty-free, sublicensable license to use, host, store, reproduce, modify (for formatting), publish, display, and distribute such User Content for the purposes of operating, improving, and marketing the Platform.
14.4. Moderation. GoJourney may (but has no obligation to) monitor, remove, or restrict access to User Content at its sole discretion, including content that violates these Terms or may expose GoJourney or others to liability.
15. Prohibited Conduct
15.1. You agree not to:
(a) violate any applicable law or regulation;
(b) misrepresent your identity, age, qualifications, certifications, permits, or insurance;
(c) post false, misleading, or unsafe listings;
(d) harass, threaten, or discriminate against others;
(e) encourage or engage in dangerous, reckless, or illegal activity during any Journey;
(f) interfere with the security, integrity, or operation of the Platform;
(g) attempt to circumvent Platform Fees (if applicable) by moving transactions off-platform in violation of GoJourney policies.
16. Disclaimer of Warranties; Platform Provided “As Is”
16.1. To the maximum extent permitted by law, the Platform and all Platform Services are provided on an “AS IS” and “AS AVAILABLE” basis. GoJourney makes no representations or warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, or that the Platform will be uninterrupted, secure, or error-free.
16.2. GoJourney does not warrant or guarantee any Guide’s services, conduct, qualifications, permits, certifications, equipment, or insurance coverage, or that any Journey will meet a Customer’s expectations.
17. Limitation of Liability
17.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GOJOURNEY, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE PLATFORM; (B) ANY JOURNEY OR SERVICES OFFERED OR PROVIDED BY A GUIDE; (C) COMMUNICATIONS OR DISPUTES BETWEEN USERS AND GUIDES; OR (D) USER CONTENT.
17.2. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOJOURNEY’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE PLATFORM, OR ANY JOURNEY SHALL NOT EXCEED THE GREATER OF: (I) USD $100; OR (II) THE TOTAL PLATFORM FEES PAID BY YOU TO GOJOURNEY IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
17.3. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
18. Indemnification
18.1. You agree to defend, indemnify, and hold harmless GoJourney and its owners, officers, directors, employees, contractors, and agents from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
(a) your use of the Platform or participation in any Journey;
(b) your breach of these Terms;
(c) your violation of any law, regulation, or third-party rights;
(d) your content, communications, or interactions with any other User or Guide; and
(e) any dispute between you and any Guide or Customer, including but not limited to claims related to personal injury, property damage, refunds, cancellations, or service quality.
18.2. GoJourney reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with GoJourney’s defense of such claims.
19. Marketplace Relationship; No Agency; No Employment
19.1. GoJourney is a technology platform and marketplace that facilitates connections between Customers and Guides. Guides are independent third parties and are not employees, agents, joint venturers, partners, or representatives of GoJourney.
19.2. GoJourney does not control, supervise, direct, or manage Guides, and does not provide the Journeys. No relationship of employment, agency, partnership, joint venture, or franchising is created by these Terms or by any use of the Platform.
19.3. Guides have no authority to bind GoJourney or make representations on GoJourney’s behalf.
20. User-to-User Disputes; Release
20.1. Any booking, agreement, dispute, or interaction regarding a Journey is between the Customer and the Guide. GoJourney is not a party to any agreement between Users and Guides and is not responsible for resolving disputes.
20.2. To the maximum extent permitted by law, you release GoJourney from any and all claims, demands, and damages of every kind and nature, known and unknown, arising out of or in any way connected with disputes between you and any other User or Guide.
21. Termination of Access
21.1. GoJourney reserves the right to terminate or suspend your access to the Platform, with or without notice, for any reason, including but not limited to a violation of these Terms and Conditions.
22. Severability; Entire Agreement; Survival; Assignment
22.1. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
22.2. These Terms constitute the entire agreement between you and GoJourney regarding the Platform and supersede any prior agreements regarding the Platform.
22.3. Sections relating to limitation of liability, disclaimers, indemnification, dispute provisions, and any other provisions that by their nature should survive, shall survive termination.
22.4. You may not assign these Terms without GoJourney’s prior written consent; GoJourney may assign these Terms in connection with a merger, acquisition, or sale of assets.
23. Governing Law and Dispute Resolution
23.1. These terms are governed by the laws of Washington State, without regard to its conflict of laws principles.
23.2. Users agree to submit to the exclusive jurisdiction of the courts in King County, Washington State.
24. Updates to Terms
24.1. GoJourney reserves the right to update these terms and conditions; check our website for the latest version.
24.2. These Terms were last updated January 25, 2026.
